Cet article se concentre sur le jeu de danse d’une petite fille de neuf ans, filmé par elle-même dans la cour d’une école primaire écossaise, en 2018. Olivia incorpore dans son jeu des objets numériques, non numériques, et son environnement, passant de la sélection de chansons sur un téléphone à la danse avec la caméra, au jeu avec le vent, et à la manipulation d’un cône de signalisation. Elle créé un espace de jeu personnel au milieu de l’espace commun, marqué (...) par la musique, le mouvement, les objets et elle-même. Cet article examine comment, à travers ce processus de danse ludique, Olivia met en scène son enfance genrée au féminin, dans sa façon d’interagir avec les gens, l’espace et les objets. Olivia s’inscrit ainsi dans la tradition du jeu dansé des filles. Mais dans la cour post-numérique, les objets numériques deviennent une partie de son jeu, suivant une autre tradition enfantine du jeu, le “bricolage”, dans lequel les enfants utilisent le monde qui les entoure, à travers le temps et l’espace. Since most research on the topic of experiences related to becoming a psychologist is conducted from a pathogenic paradigm, the study reported in this paper aimed to describe the journey of a clinical master’s student from the perspective of positive psychology. A strengths-based paradigm allowed the researcher and the participant to understand the journey through the lens of personal growth, professional development, coping strategies, and attempts to make sense of the related difficulties. In this study, a qualitative research approach was (...) used and a single case study design was employed. Data analysis followed the procedure of interpretative phenomenological analysis. Themes that were conceptualized and operationalized within the structure of psychological well-being comprised six well-being domains, namely personal growth; purpose in life; autonomy; self-acceptance; positive relationships with others; and environmental mastery. The most prominent finding was that, while the experience of becoming a psychologist is known to be a long and difficult journey, it can also be rewarding and positive, and holds the potential to enhance psychological well-being. Evidence does not support the claim that observers universally recognize basic emotions from signals on the face. The percentage of observers who matched the face with the predicted emotion (matching score) is not universal, but varies with culture and language. Matching scores are also inflated by the commonly used methods: within-subject design; posed, exaggerated facial expressions (devoid of context); multiple examples of each type of expression; and a response format that funnels a variety of interpretations into one word specified by (...) the experimenter. Without these methodological aids, matching scores are modest and subject to various explanations. (shrink)

The question I want to explore is whether experience supports an antireductionist ontology of time, that is, whether we should take it to support an ontology that includes a primitive, monadic property of nowness responsible for the special feel of events in the present, and a relation of passage that events instantiate in virtue of literally passing from the future, to the present, and then into the past.

The term fuzzy logic is used in this paper to describe an imprecise logical system, FL, in which the truth-values are fuzzy subsets of the unit interval with linguistic labels such as true, false, not true, very true, quite true, not very true and not very false, etc. The truth-value set, , of FL is assumed to be generated by a context-free grammar, with a semantic rule providing a means of computing the meaning of each linguistic truth-value in as a (...) fuzzy subset of [0, 1].Since is not closed under the operations of negation, conjunction, disjunction and implication, the result of an operation on truth-values in requires, in general, a linguistic approximation by a truth-value in . As a consequence, the truth tables and the rules of inference in fuzzy logic are (i) inexact and (ii) dependent on the meaning associated with the primary truth-value true as well as the modifiers very, quite, more or less, etc. (shrink)

What follows is an attempt to do some conceptual housekeeping around the notion of secret law as provided by Christopher Kutz (2013). First I consider low-salience (or merely obscure) law, suggesting that it fails to capture the legal and moral facts that are at stake in the case which Kutz used to motivate it. Then I outline a theoretical contrast between mere obscurity and secrecy, in contrast to the 'neutral' account of secrecy provided by Sissela Bok (1989). The upshot of (...) the two sections is that low-salience law is neither secret law nor necessarily problematic, though it closely resembles a kind of law that is both secret and problematic: namely, those legal obscurities that subvert manifest interests related to the informational needs of citizens. The ensuing argument undermines the fiction of constructive presence found in Austin and Blackstone. (shrink)

There at least three ways of thinking about rationality: instrumental, substantive, and intentional. By far, the instrumental account is most influential. This essay proposes that intentional rationality can provide substantive accounts with room to breathe, and in a way that is facially distinct from instrumental accounts. I suggest that the intentionality of a judgment is made up of what it is about and the orientation through which it is judged, while irrationality is the subversion of a strict supporting connection between (...) the judgment and its corresponding set of coordinated attitudes (reasons). It follows that irrational intentionality is made up of episodic states where a judgment is subverted because of a misalignment between what it is about and the way the judge is oriented towards its contents. Four examples of irrational intentionality are considered: passivity towards ends, constitutive ignorance towards facts, delirious paranoia towards objects, and a disjunctive orientation towards categorizations. This paper explores the possibility that Hobbesian jurisprudence is best understood as a ‘third way’ in legal theory, irreducible to classical natural law or legal positivism. I sketch two potential ‘third theories’ of law -- legal pragmatism and legal dualism -- and argue that, when considered in its broadest sense, Leviathan is best viewed as an example of legal pragmatism. I consider whether this legal pragmatist interpretation can be sustained in the examination of Leviathan’s treatment of civil law, and argue (...) that the pragmatic interpretation can only be successful if we can resolve two textual issues in that chapter. First, while Hobbes argues that law entails the existence of public (sharable) reasons, he does not adequately defend the view that the sovereign is the unique authority over such reasons in all cases, especially as far as they concern known collective emergencies. Second, Hobbes both affirms and denies that a sovereign can fail to do justice, which is paradoxical. Both problems are best resolved by legal pragmatism, though the second problem resists a fully satisfying resolution. The upshot is that, although Leviathan ought to be regarded as an episode of legal pragmatism, there are trade-offs on every reading. (shrink)

In this paper I argue that textualism is far less attractive as a theory of written law than some of its modern proponents think. For it is not usually sensible to expect the grammatical meaning of a provision to determine its appropriate legal meaning. Factors that are unrelated to grammar in the identification of law (e.g., legal theory, context) do too much of the work. **Draft -- acknowledgments welcome, but please do not cite.**.

Monists about material constitution typically argue that when Statue is materially constituted by Clay, Statue is just Clay. Pluralists about material constitution deny that constitution is identity: Statue is not just Clay. When Clay materially constitutes Statue, Clay is not identical to Statue. I discuss three familiar puzzles involving grounding, overdetermination and conceptual issues, and develop three new puzzles stemming from the connection between mereological composition and material constitution: a mereological puzzle, an asymmetry puzzle, and a structural puzzle.

In any society influenced by a plurality of cultures, there will be widespread, systematic differences about at least some important values, including moral values. Many of these differences look like deep disagreements, difficult to resolve objectively if that is possible at all. One common response to the suspicion that these disagreements are unsettleable has always been moral relativism. In the flurry of sympathetic treatments of this doctrine in the last two decades, attention has understandably focused on the simpler case in (...) which one fairly self-contained and culturally homogeneous society confronts, at least in thought, the values of another; but most have taken relativism to have implications within a single pluralistic society as well. I am not among the sympathizers. That is partly because I am more optimistic than many about how many moral disagreements can be settled, but I shall say little about that here. For, even on the assumption that many disputes are unsettleable, I continue to find relativism a theoretically puzzling reaction to the problem of moral disagreement, and a troubling one in practice, especially when the practice involves regular interaction among those who disagree. I claim that Mill has a theory of poetry which he uses to reconcile nineteenth century associationist psychology, the tendency of the intellect to dissolve associations, and the need for educated members of society to desire utilitarian ends. The heart of the argument is that Mill thinks reading poetry encourages us to feel the feelings of others, and thus to develop pleasurable associations with the pleasurable feelings of others and painful associations with the painful feelings of others. Once the associations (...) are developed, they are supported and maintained by our natural capacity for sympathy and by external elements in society, and provide motivation for the pursuit of utilitarian ends. Further, the additional support causes the associations to be strengthened to the extent that they come to be seen as ‘natural and necessary’, and as such are immune from the dissolving force of the intellect. A weak form of intuitionistic set theory WST lacking the axiom of extensionality is introduced. While WST is too weak to support the derivation of the law of excluded middle from the axiom of choice, we show that beefing up WST with moderate extensionality principles or quotient sets enables the derivation to go through.

There is no historians' consensus about the ninth century. Opinions have been both highly judgmental and bewilderingly disparate. The most common diagnosis has been of disintegration and decline: the terminal illness of the Carolingian state. But some more sanguine observers have claimed to find here transformation and a political creativity decisive for the future of western Europe. On any reckoning, the ninth century was an important period. Yet it remains as true as when Walter Schlesinger made the observation twenty years (...) ago that a history of the ninth century in and for itself has still to be written. When it is, an interpretation of the events between 840 and 843 will surely be given a central place. For it was during those years that Carolingian Europe underwent most obviously those changes which historians have held characteristic and seminal in the century as a whole. At the beginning of 840 the Carolingian Empire persisted as a political entity; in 843 it no longer did so. The quest for an understanding of what happened during these critical years must start from a thorough reexamination of the relevant sources, and a number of recent studies show that this task is already well under way. But one text, though not wholly neglected by modern scholarship, still stands in need of closer attention and reappraisal: the Histories of Nithard. (shrink)

Originally published in 1995 this is the fifth volume in the series Creationism in 20th Century America. It re-publishes After Its Kind - a critique on theories of biological evolution and a defense of the biblical account of creation which Nelson wrote when he was a Pastor in New Jersey where he also attended classes in genetics and zoology at Rutgers university. His 1931 volume The Deluge Story in Stone: A History of the Flood Theory of Geology, also reprinted here (...) was continuously in print until the 1960s. As his scientific and theological correspondence expanded in the wake of his publications, Nelson became further involved in the 'evolution debates'. During the late 1930s his writings concentrated on early man and the glacial phenomena he saw all about him in Wisconsin and he compiled the materials he thought necessary to relate Scripture to the evidence of human antiquity.
